Terms of Service

1. The Service

Pulse is a software-as-a-service platform that helps brands monitor and improve visibility in AI-powered discovery and search experiences. Features may include prompts, reports, competitor tracking, usage limits by plan, and integrations with third-party AI systems. We may add, change, or discontinue features with reasonable notice where practicable.

2. Accounts and eligibility

• You must provide accurate registration information and keep credentials confidential.
• You are responsible for activity under your account and must notify us promptly of unauthorised access.
• You must be at least 18 years old (or the age of majority in your jurisdiction) to use paid features.
• One person or legal entity may not share login credentials across unrelated organisations without our consent.

3. Subscriptions, trials, and billing

Paid plans, free trials, and usage limits are described on pulse.morph.ae and in your account. Payments are processed by Stripe or other designated processors. By subscribing, you authorise recurring charges at the displayed price until you cancel in accordance with Stripe and account settings.

• Trials convert to paid plans unless cancelled before the trial ends, where applicable.
• Fees are exclusive of taxes unless stated otherwise; you are responsible for applicable taxes.
• We may change prices for future billing periods with notice; continued use after the effective date constitutes acceptance.
• Refunds are provided only where required by law or explicitly stated in writing by Morph.

4. Acceptable use

You agree not to:

• Use Pulse for unlawful, deceptive, or harmful purposes.
• Scrape, reverse engineer, or overload the Service except as permitted by law or written agreement.
• Submit content that infringes intellectual property, privacy, or other rights of third parties.
• Attempt to bypass usage limits, security controls, or another user’s account.
• Resell or white-label Pulse without a separate written agreement with Morph.

5. Your content and our outputs

You retain ownership of data and materials you submit (“Customer Content”). You grant Morph a worldwide, non-exclusive licence to host, process, and display Customer Content solely to provide and improve the Service.

AI-generated reports and recommendations are provided for informational purposes. You are responsible for reviewing outputs before relying on them for business or legal decisions. Outputs may be inaccurate or incomplete.

6. Morph intellectual property

Pulse, the Morph name, logos, software, and documentation are owned by Morph or its licensors. Except for the limited right to use the Service under these Terms, no rights are granted to you.

7. Third-party services

The Service may rely on third parties (e.g. AI providers, Stripe, analytics). Their terms and privacy policies apply to their services. Morph is not responsible for third-party outages or acts outside our reasonable control.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MORPH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE SPECIFIC AI RANKINGS, TRAFFIC, OR REVENUE OUTCOMES.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MORPH AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO MORPH FOR PULSE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD 100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

10. Indemnity

You will defend and indemnify Morph against claims arising from your Customer Content, misuse of the Service, or breach of these Terms, except to the extent caused by Morph’s gross negligence or wilful misconduct.

11. Suspension and termination

You may stop using Pulse and cancel subscriptions through your account or Stripe. We may suspend or terminate access for breach of these Terms, non-payment, or risk to the Service or other users. Upon termination, your right to use Pulse ends; sections that by nature should survive (e.g. IP, disclaimers, liability, indemnity) will survive.

12. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules. Courts in the UAE shall have exclusive jurisdiction, unless mandatory consumer protection laws in your country require otherwise.

Before formal proceedings, parties agree to attempt good-faith resolution by contacting pulse@morph.ae.

13. General

• These Terms, together with the Privacy Policy and plan-specific terms on the site, are the entire agreement regarding Pulse.
• If any provision is unenforceable, the remainder stays in effect.
• Failure to enforce a provision is not a waiver.
• You may not assign these Terms without our consent; we may assign them in connection with a corporate transaction.
